Disclaimer and terms of use

Please read these terms carefully before downloading or using any IFCToolset application (“the Software”). By downloading, copying, installing, running or otherwise using the Software you agree to be bound by them. If you do not agree, do not download or use the Software. The Software is provided for BIM education purposes only and may not be used in any commercial or business application. The Author takes no responsibility for the results it produces, which are not reliable for real-life implementation. Applications other than Orinel★ mini may be used only by students of the IFCToolset Live Training. Distributing the Software to third parties, reverse engineering it or cracking it is strictly prohibited and will be pursued in the courts of İstanbul, Republic of Türkiye.

1. BIM education use only

The Software is made available solely for education and training in Building Information Modelling (BIM) — for learning, teaching and non-commercial academic exercises. It may not be used, in whole or in part, in any commercial or business application, including without limitation paid or professional design, engineering, consultancy, construction, facility-management, cost-estimating or compliance work, work carried out for a client or employer, or any product or service offered for a fee. Any use outside BIM education is not licensed, is a breach of these terms, and is entirely at your own risk.

2. Authorised users and authorised copies

Orinel★ mini may be downloaded from this website and used by anyone for BIM education, subject to these terms. All other IFCToolset applications may be used only by students who are enrolled in, or have completed, the IFCToolset Live Training, and only under the personal, non-exclusive, non-transferable and revocable licence granted to them by the Author. Only copies obtained directly from this website or delivered directly by the Author at the IFCToolset Live Training may be used. Copies obtained from any other source are unlicensed; their use is prohibited and constitutes infringement of the Author’s rights.

3. No distribution to third parties

Distribution of the Software to third parties is strictly prohibited and unlawful. You may not copy, share, publish, upload, mirror, host, transmit, lend, give away, sell, rent, lease, sublicense or otherwise make available the Software, any part of it, or any licence or access to it, to any other person or organisation, by any means — including file-sharing services, websites, networks, removable media or messaging — whether for payment or free of charge. Each copy is licensed to its user alone. Any distribution constitutes infringement of the Author’s copyright and of these terms.

4. No reverse engineering, cracking or tampering

You may not, and may not attempt to, reverse engineer, decompile, disassemble, decrypt, crack, patch, modify, adapt or create derivative works of the Software, or extract its source code, algorithms or internal structure; remove, bypass, disable or circumvent any licence check, usage restriction, file-size limit, protection measure or technical limitation; or remove or alter any copyright, licence, trademark or attribution notice. This applies to the Author’s own code and to the Software as a whole; it does not restrict any right that the licence of an included open-source component grants in respect of that component (see clause 12).

5. Legal action

The Software is protected by the copyright and intellectual-property laws of the Republic of Türkiye, including Law No. 5846 on Intellectual and Artistic Works, and by international treaties. Any unauthorised use, distribution, reverse engineering, cracking, tampering or other breach of these terms will be pursued by the Author to the fullest extent of the law, in the courts of İstanbul, Republic of Türkiye. The Author reserves and will exercise every civil and criminal remedy available, including without limitation injunctions and interim measures, the seizure and destruction of infringing copies and the means used to make them, claims for material and moral damages and for the profits obtained by the infringer, criminal complaints to the competent public prosecutor, and the publication of court decisions. The infringer shall bear all costs incurred by the Author in detecting, investigating and acting on the breach, including court costs and attorneys’ fees. Any breach terminates your licence immediately and automatically, without notice; on termination you must stop using the Software and destroy all copies in your possession. Termination does not affect the Author’s right to claim damages for the breach.

6. No warranty

The Software is provided “as is” and “as available”, with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, the author, Ümit Işıkdağ, and any copyright holders (together “the Author”) disclaim all warranties, whether express, implied, statutory or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, reliability, quiet enjoyment, system integration and freedom from errors, defects, viruses or other harmful components. The Author does not warrant that the Software will meet your requirements, operate without interruption, be compatible with your hardware, software or files, or that defects will be corrected. No advice or information, oral or written, obtained from the Author or through this website creates any warranty not expressly stated in these terms.

7. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall the Author be liable to you or to any third party for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, files, models, profits, revenue, business, contracts, goodwill or anticipated savings, business interruption, cost of substitute goods or services, project delays, construction defects, personal injury, property damage, or damage to hardware, software or systems, however caused and under any theory of liability — whether in contract, tort (including negligence), strict liability or otherwise — arising out of or in connection with the download, installation, use, misuse or inability to use the Software or any results it produces, even if the Author has been advised of the possibility of such damages. Because the Software is provided free of charge, where liability cannot be excluded entirely, the Author’s total aggregate liability shall not exceed the amount you paid for the Software, which is zero.

8. Not professional advice

The Software is a technical aid. It does not provide engineering, architectural, structural, fire-safety, accessibility, energy, environmental, cost-consultancy, legal or any other professional advice, and it does not certify compliance with any building code, regulation, standard or contract. Nothing produced by the Software replaces the judgement, review and sign-off of a suitably qualified and licensed professional.

9. Results: no responsibility, not for real-life implementation

The Author takes no responsibility whatsoever for any result produced by the Software. The results are not reliable for real-life implementation and must not be used as the basis of any real design, construction, safety, procurement, financial, legal or other decision. All outputs of the Software — including but not limited to geometry, quantities, areas, volumes, costs, carbon figures, clash results, schedules, compliance and validation results, fire, egress, daylight, acoustic, thermal, solar and structural checks, and any exported or compressed files — are produced for BIM education only. They depend on the content and quality of the input files, on third-party libraries and on simplified assumptions and default rules built into the Software, and may be incomplete, approximate or wrong. Any reliance on them is entirely at your own risk.

10. Your files and your responsibility

You are solely responsible for your use of the Software, for the files you open, process, convert, compress or export with it, and for keeping complete and current backups of all your data. Always work on copies of important files. Files written by the Software, including compressed or converted IFC files, may differ from the originals; you are responsible for checking them before use. You are responsible for ensuring that you have the right to use any file you process, and for complying with all laws, regulations, contracts and third-party rights that apply to your use of the Software and its outputs.

11. Indemnification

You agree to indemnify, defend and hold harmless the Author from and against any claims, demands, losses, liabilities, damages, costs and expenses (including reasonable legal fees) brought by any third party or arising out of or relating to your use or misuse of the Software, any result or file produced with it, your breach of these terms, or your violation of any law or the rights of any third party.

12. Third-party components, open-source rights and licence notices

The Software includes third-party open-source components and Microsoft runtimes, each used under its own licence. All rights granted by the open-source licences of the components used in the tools remain fully valid. Each component remains subject to its own licence, and nothing in these terms limits, overrides or takes away any right, permission or obligation that such a licence grants in respect of that component — including the rights to use, study, modify and redistribute the component itself, and to obtain its source code where the licence provides for it. The restrictions in these terms apply to the Author’s own work and to the Software as a whole, not to those components. The third-party licence notices can be found inside each app: open the app’s menu (top left) and choose Third-party licenses. Such components are provided by their respective owners without warranty from the Author, and the Author accepts no responsibility or liability for them.

13. Downloads and security

Only copies obtained from this website or delivered by the Author at the IFCToolset Live Training are authorised (see clause 2). The Author is not responsible for copies obtained from any other source, or for any modification made to the Software by anyone else. Although reasonable care is taken, the Author does not guarantee that the Software or this website is free of viruses or other harmful components, and it is your responsibility to scan downloaded files and protect your systems. Your operating system or security software may warn about software from independent developers; deciding whether to run the Software is your responsibility.

14. No support or updates

The Author is under no obligation to provide support, maintenance, updates, corrections or new versions of the Software, or to keep the Software or this website available. The Software, its features and these terms may be changed, suspended or discontinued at any time without notice.

15. Licence and permitted use

The Software is licensed, not sold. It is freeware for BIM education: you may use it free of charge for BIM education and training only, within the limits of clauses 1 to 4. Commercial and business use of any kind is not permitted. The Software and all copyright and other intellectual-property rights in it remain the exclusive property of the Author. All rights not expressly granted in these terms are reserved by the Author. The Software is not commercial software. Selling it — or charging any fee for it, for a copy of it or for access to it — is strictly prohibited. The Software is closed source: its source code is not published or provided, and no right to obtain, view, inspect or derive it is granted.

16. Privacy

The Software runs locally on your computer and is designed to work offline; it does not upload your models or files. You remain responsible for the security and confidentiality of the data you process with it.

17. High-risk use

The Software is not designed, intended or certified for use where its failure, or an error in its results, could lead to death, personal injury, or severe physical, property or environmental damage. Any such use is entirely at your own risk.

18. Governing law, jurisdiction and severability

These terms, and any dispute or claim arising out of or in connection with the Software or these terms, are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İstanbul (İstanbul Mahkemeleri ve İcra Daireleri) have exclusive jurisdiction, and you submit to that jurisdiction. Where the law of your country does not allow the exclusion of certain warranties or the limitation of certain liabilities, the exclusions and limitations above apply to the greatest extent permitted. If any provision of these terms is found to be invalid or unenforceable, it shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

19. Changes to these terms

The Author may revise these terms at any time by publishing an updated version on this website. The version in effect when you download or use the Software applies to that download or use.

20. Acceptance

By downloading or using the Software you confirm that you have read, understood and accepted these terms, and that you use the Software entirely at your own risk.

21. Language versions

These terms are published in English, Turkish, French, German, Italian and Spanish. In case of any discrepancy or difference in interpretation between the language versions, the Turkish version prevails.
