Disclaimer and terms of use
Please read these terms carefully before downloading or using any IFCToolset application
(“the Software”). By downloading, copying, installing, running or otherwise using the Software you
agree to be bound by them. If you do not agree, do not download or use the Software.
The Software is provided for BIM education purposes only and may not be used in any commercial
or business application. The Author takes no responsibility for the results it produces, which are not
reliable for real-life implementation. Applications other than Orinel★ mini may be used only by students of
the IFCToolset Live Training. Distributing the Software to third parties, reverse engineering it or cracking
it is strictly prohibited and will be pursued in the courts of İstanbul, Republic of Türkiye.
1. BIM education use only
The Software is made available solely for education and training in Building Information Modelling
(BIM) — for learning, teaching and non-commercial academic exercises. It may not be used, in whole or
in part, in any commercial or business application, including without limitation paid or professional
design, engineering, consultancy, construction, facility-management, cost-estimating or compliance work, work
carried out for a client or employer, or any product or service offered for a fee. Any use outside BIM
education is not licensed, is a breach of these terms, and is entirely at your own risk.
2. Authorised users and authorised copies
Orinel★ mini may be downloaded from this website and used by anyone for BIM education, subject to these terms.
All other IFCToolset applications may be used only by students who are enrolled in, or have completed,
the IFCToolset Live Training, and only under the personal, non-exclusive, non-transferable and revocable
licence granted to them by the Author. Only copies obtained directly from this website or delivered
directly by the Author at the IFCToolset Live Training may be used. Copies obtained from any other
source are unlicensed; their use is prohibited and constitutes infringement of the Author’s rights.
3. No distribution to third parties
Distribution of the Software to third parties is strictly prohibited and unlawful. You may not
copy, share, publish, upload, mirror, host, transmit, lend, give away, sell, rent, lease, sublicense or otherwise
make available the Software, any part of it, or any licence or access to it, to any other person or organisation,
by any means — including file-sharing services, websites, networks, removable media or messaging — whether for
payment or free of charge. Each copy is licensed to its user alone. Any distribution constitutes infringement of
the Author’s copyright and of these terms.
4. No reverse engineering, cracking or tampering
You may not, and may not attempt to, reverse engineer, decompile, disassemble, decrypt, crack, patch,
modify, adapt or create derivative works of the Software, or extract its source code, algorithms or
internal structure; remove, bypass, disable or circumvent any licence check, usage restriction, file-size limit,
protection measure or technical limitation; or remove or alter any copyright, licence, trademark or attribution
notice. This applies to the Author’s own code and to the Software as a whole; it does not restrict any right that
the licence of an included open-source component grants in respect of that component (see clause 12).
5. Legal action
The Software is protected by the copyright and intellectual-property laws of the Republic of Türkiye, including
Law No. 5846 on Intellectual and Artistic Works, and by international treaties. Any unauthorised use,
distribution, reverse engineering, cracking, tampering or other breach of these terms will be pursued by the
Author to the fullest extent of the law, in the courts of İstanbul, Republic of Türkiye. The Author reserves
and will exercise every civil and criminal remedy available, including without limitation injunctions and
interim measures, the seizure and destruction of infringing copies and the means used to make them, claims for
material and moral damages and for the profits obtained by the infringer, criminal complaints to the competent
public prosecutor, and the publication of court decisions. The infringer shall bear all costs incurred by the
Author in detecting, investigating and acting on the breach, including court costs and attorneys’ fees. Any breach
terminates your licence immediately and automatically, without notice; on termination you must stop using the
Software and destroy all copies in your possession. Termination does not affect the Author’s right to claim
damages for the breach.
6. No warranty
The Software is provided “as is” and “as available”, with all faults and without warranty of
any kind. To the maximum extent permitted by applicable law, the author, Ümit Işıkdağ, and any copyright
holders (together “the Author”) disclaim all warranties, whether express, implied, statutory or otherwise,
including without limitation any warranties of merchantability, fitness for a particular purpose, title,
non-infringement, accuracy, completeness, reliability, quiet enjoyment, system integration and freedom from
errors, defects, viruses or other harmful components. The Author does not warrant that the Software will meet
your requirements, operate without interruption, be compatible with your hardware, software or files, or
that defects will be corrected. No advice or information, oral or written, obtained from the Author or through
this website creates any warranty not expressly stated in these terms.
7. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall the Author be liable to you or to any
third party for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or for
any loss of data, files, models, profits, revenue, business, contracts, goodwill or anticipated savings,
business interruption, cost of substitute goods or services, project delays, construction defects, personal
injury, property damage, or damage to hardware, software or systems, however caused and under any theory of
liability — whether in contract, tort (including negligence), strict liability or otherwise — arising out of
or in connection with the download, installation, use, misuse or inability to use the Software or any results
it produces, even if the Author has been advised of the possibility of such damages. Because the Software is
provided free of charge, where liability cannot be excluded entirely, the Author’s total aggregate liability
shall not exceed the amount you paid for the Software, which is zero.
8. Not professional advice
The Software is a technical aid. It does not provide engineering, architectural, structural, fire-safety,
accessibility, energy, environmental, cost-consultancy, legal or any other professional advice, and it does not
certify compliance with any building code, regulation, standard or contract. Nothing produced by the Software
replaces the judgement, review and sign-off of a suitably qualified and licensed professional.
9. Results: no responsibility, not for real-life implementation
The Author takes no responsibility whatsoever for any result produced by the Software. The results are
not reliable for real-life implementation and must not be used as the basis of any real design,
construction, safety, procurement, financial, legal or other decision. All outputs of the Software — including
but not limited to geometry, quantities, areas, volumes, costs, carbon figures, clash results, schedules,
compliance and validation results, fire, egress, daylight, acoustic, thermal, solar and structural checks, and
any exported or compressed files — are produced for BIM education only. They depend on the content and quality
of the input files, on third-party libraries and on simplified assumptions and default rules built into the
Software, and may be incomplete, approximate or wrong. Any reliance on them is entirely at your own risk.
10. Your files and your responsibility
You are solely responsible for your use of the Software, for the files you open, process, convert, compress or
export with it, and for keeping complete and current backups of all your data. Always work on copies of
important files. Files written by the Software, including compressed or converted IFC files, may differ from the
originals; you are responsible for checking them before use. You are responsible for ensuring that you have the
right to use any file you process, and for complying with all laws, regulations, contracts and third-party
rights that apply to your use of the Software and its outputs.
11. Indemnification
You agree to indemnify, defend and hold harmless the Author from and against any claims, demands, losses,
liabilities, damages, costs and expenses (including reasonable legal fees) brought by any third party or
arising out of or relating to your use or misuse of the Software, any result or file produced with it, your
breach of these terms, or your violation of any law or the rights of any third party.
12. Third-party components, open-source rights and licence notices
The Software includes third-party open-source components and Microsoft runtimes, each used under its own licence.
All rights granted by the open-source licences of the components used in the tools remain fully valid.
Each component remains subject to its own licence, and nothing in these terms limits, overrides or takes away any
right, permission or obligation that such a licence grants in respect of that component — including the rights to
use, study, modify and redistribute the component itself, and to obtain its source code where the licence provides
for it. The restrictions in these terms apply to the Author’s own work and to the Software as a whole, not to those
components. The third-party licence notices can be found inside each app: open the app’s menu
(top left) and choose Third-party licenses. Such components are provided by their respective owners
without warranty from the Author, and the Author accepts no responsibility or liability for them.
13. Downloads and security
Only copies obtained from this website or delivered by the Author at the IFCToolset Live Training are authorised
(see clause 2). The Author is not responsible for copies obtained from any other source, or for any
modification made to the Software by anyone else. Although reasonable care is taken, the
Author does not guarantee that the Software or this website is free of viruses or other harmful components, and
it is your responsibility to scan downloaded files and protect your systems. Your operating system or security
software may warn about software from independent developers; deciding whether to run the Software is your
responsibility.
14. No support or updates
The Author is under no obligation to provide support, maintenance, updates, corrections or new versions of the
Software, or to keep the Software or this website available. The Software, its features and these terms may be
changed, suspended or discontinued at any time without notice.
15. Licence and permitted use
The Software is licensed, not sold. It is freeware for BIM education: you may use it free of charge for BIM
education and training only, within the limits of clauses 1 to 4. Commercial and business use of any kind is not
permitted. The Software and all copyright and other intellectual-property rights in it remain the exclusive
property of the Author. All rights not expressly granted in these terms are reserved by the Author.
The Software is not commercial software. Selling it — or charging any fee for it, for a copy of it or for access to it — is strictly prohibited. The Software is closed source: its source code is not published or provided, and no right to obtain, view, inspect or derive it is granted.
16. Privacy
The Software runs locally on your computer and is designed to work offline; it does not upload your models or
files. You remain responsible for the security and confidentiality of the data you process with it.
17. High-risk use
The Software is not designed, intended or certified for use where its failure, or an error in its results,
could lead to death, personal injury, or severe physical, property or environmental damage. Any such use is
entirely at your own risk.
18. Governing law, jurisdiction and severability
These terms, and any dispute or claim arising out of or in connection with the Software or these terms, are
governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İstanbul
(İstanbul Mahkemeleri ve İcra Daireleri) have exclusive jurisdiction, and you submit to that jurisdiction. Where the law of your country does not
allow the exclusion of certain warranties or the limitation of certain liabilities, the exclusions and
limitations above apply to the greatest extent permitted. If any provision of these terms is found to be invalid
or unenforceable, it shall be enforced to the maximum extent permissible and the remaining provisions shall
remain in full force and effect.
19. Changes to these terms
The Author may revise these terms at any time by publishing an updated version on this website. The version in
effect when you download or use the Software applies to that download or use.
20. Acceptance
By downloading or using the Software you confirm that you have read, understood and accepted these terms, and
that you use the Software entirely at your own risk.
21. Language versions
These terms are published in English, Turkish, French, German, Italian and Spanish. In case of any discrepancy
or difference in interpretation between the language versions, the Turkish version prevails.
Haftungsausschluss und Nutzungsbedingungen
Bitte lesen Sie diese Bedingungen sorgfältig, bevor Sie eine IFCToolset-Anwendung („die Software“)
herunterladen oder verwenden. Durch das Herunterladen, Kopieren, Installieren, Ausführen oder jede sonstige Nutzung
der Software erklären Sie sich mit diesen Bedingungen einverstanden. Wenn Sie nicht einverstanden sind, dürfen Sie die
Software weder herunterladen noch verwenden.
Die Software wird ausschließlich für Zwecke der BIM-Ausbildung bereitgestellt und darf in keiner kommerziellen
oder geschäftlichen Anwendung eingesetzt werden. Der Autor übernimmt keinerlei Verantwortung für die von ihr erzeugten
Ergebnisse; diese sind für die Umsetzung in der Praxis nicht zuverlässig. Andere Anwendungen als Orinel★ mini dürfen
nur von Teilnehmenden des IFCToolset Live Training verwendet werden. Die Weitergabe der Software an Dritte, ihr Reverse
Engineering oder Cracking ist streng verboten und wird vor den Gerichten von İstanbul, Republik Türkiye, verfolgt.
1. Nutzung ausschließlich für die BIM-Ausbildung
Die Software wird ausschließlich für die Aus- und Weiterbildung im Building Information Modelling
(BIM) bereitgestellt — zum Lernen, Lehren und für nichtkommerzielle akademische Übungen. Sie darf weder
ganz noch teilweise in einer kommerziellen oder geschäftlichen Anwendung eingesetzt werden, insbesondere nicht für
bezahlte oder berufliche Planungs-, Ingenieur-, Beratungs-, Bau-, Facility-Management-, Kostenermittlungs- oder
Konformitätsprüfungsleistungen, für Arbeiten im Auftrag eines Kunden oder Arbeitgebers oder für entgeltlich angebotene
Produkte oder Dienstleistungen. Jede Nutzung außerhalb der BIM-Ausbildung ist nicht lizenziert, stellt einen Verstoß
gegen diese Bedingungen dar und erfolgt ausschließlich auf Ihr eigenes Risiko.
2. Berechtigte Nutzer und berechtigte Kopien
Orinel★ mini darf von dieser Website heruntergeladen und vorbehaltlich dieser Bedingungen von jedermann für die
BIM-Ausbildung verwendet werden. Alle anderen IFCToolset-Anwendungen dürfen nur von Teilnehmenden verwendet
werden, die für das IFCToolset Live Training angemeldet sind oder es abgeschlossen haben, und nur im Rahmen der
ihnen vom Autor eingeräumten persönlichen, nicht ausschließlichen, nicht übertragbaren und widerruflichen Lizenz.
Es dürfen nur Kopien verwendet werden, die direkt von dieser Website bezogen oder vom Autor im Rahmen des
IFCToolset Live Training direkt übergeben wurden. Aus anderen Quellen bezogene Kopien sind nicht lizenziert;
ihre Nutzung ist verboten und stellt eine Verletzung der Rechte des Autors dar.
3. Keine Weitergabe an Dritte
Die Weitergabe der Software an Dritte ist streng verboten und rechtswidrig. Sie dürfen die Software,
Teile davon oder eine Lizenz bzw. einen Zugang dazu weder kopieren, teilen, veröffentlichen, hochladen, spiegeln,
hosten, übermitteln, verleihen, verschenken, verkaufen, vermieten, verleasen, unterlizenzieren noch auf sonstige Weise
einer anderen Person oder Organisation zugänglich machen — auf keinem Weg, einschließlich Filesharing-Diensten,
Websites, Netzwerken, Wechseldatenträgern oder Messaging, weder entgeltlich noch unentgeltlich. Jede Kopie ist
ausschließlich an ihren Nutzer lizenziert. Jede Weitergabe stellt eine Verletzung des Urheberrechts des Autors und
dieser Bedingungen dar.
4. Kein Reverse Engineering, Cracking oder Manipulieren
Sie dürfen die Software weder zurückentwickeln (Reverse Engineering), dekompilieren, disassemblieren,
entschlüsseln, cracken, patchen, verändern, bearbeiten noch abgeleitete Werke davon erstellen, und dies auch nicht
versuchen; ebenso wenig dürfen Sie ihren Quellcode, ihre Algorithmen oder ihre interne Struktur extrahieren,
Lizenzprüfungen, Nutzungsbeschränkungen, Dateigrößenbegrenzungen, Schutzmaßnahmen oder technische Beschränkungen
entfernen, umgehen, deaktivieren oder aushebeln oder Urheberrechts-, Lizenz-, Marken- oder Quellenvermerke entfernen
oder verändern. Dies gilt für den eigenen Code des Autors und für die Software als Ganzes; es beschränkt keine Rechte,
die die Lizenz einer enthaltenen Open-Source-Komponente in Bezug auf diese Komponente gewährt (siehe Ziffer 12).
5. Rechtliche Schritte
Die Software ist durch das Urheber- und Immaterialgüterrecht der Republik Türkiye, einschließlich des Gesetzes
Nr. 5846 über geistige und künstlerische Werke, sowie durch internationale Abkommen geschützt. Jede unbefugte
Nutzung, Weitergabe, jedes Reverse Engineering, Cracking, Manipulieren oder jeder sonstige Verstoß gegen diese
Bedingungen wird vom Autor mit allen rechtlich zulässigen Mitteln vor den Gerichten von İstanbul, Republik Türkiye,
verfolgt. Der Autor behält sich alle verfügbaren zivil- und strafrechtlichen Rechtsbehelfe vor und wird sie
ausüben, insbesondere Unterlassungsansprüche und einstweilige Maßnahmen, die Beschlagnahme und Vernichtung
rechtsverletzender Kopien und der zu ihrer Herstellung verwendeten Mittel, Ansprüche auf Ersatz des materiellen und
immateriellen Schadens sowie auf Herausgabe des vom Verletzer erzielten Gewinns, Strafanzeigen bei der zuständigen
Staatsanwaltschaft und die Veröffentlichung gerichtlicher Entscheidungen. Der Verletzer trägt sämtliche Kosten, die dem
Autor durch die Feststellung, Untersuchung und Verfolgung des Verstoßes entstehen, einschließlich Gerichts- und
Anwaltskosten. Jeder Verstoß beendet Ihre Lizenz sofort und automatisch ohne Ankündigung; bei Beendigung müssen Sie
die Nutzung der Software einstellen und alle in Ihrem Besitz befindlichen Kopien vernichten. Die Beendigung lässt das
Recht des Autors, Schadensersatz für den Verstoß zu verlangen, unberührt.
6. Keine Gewährleistung
Die Software wird „wie besehen“ und „wie verfügbar“, mit allen Mängeln und ohne jegliche Gewährleistung
bereitgestellt. Soweit nach geltendem Recht zulässig, schließen der Autor, Ümit Işıkdağ, und alle Urheberrechtsinhaber
(zusammen „der Autor“) jede ausdrückliche, stillschweigende, gesetzliche oder sonstige Gewährleistung aus,
insbesondere hinsichtlich Marktgängigkeit, Eignung für einen bestimmten Zweck, Rechtsinhaberschaft, Nichtverletzung von
Rechten Dritter, Richtigkeit, Vollständigkeit, Zuverlässigkeit, ungestörter Nutzung, Systemintegration sowie Freiheit
von Fehlern, Mängeln, Viren oder anderen schädlichen Bestandteilen. Der Autor gewährleistet nicht, dass die Software
Ihren Anforderungen entspricht, unterbrechungsfrei funktioniert, mit Ihrer Hardware, Software oder Ihren Dateien
kompatibel ist oder dass Fehler behoben werden. Mündliche oder schriftliche Hinweise oder Informationen des Autors oder
dieser Website begründen keine Gewährleistung, die in diesen Bedingungen nicht ausdrücklich vorgesehen ist.
7. Haftungsbeschränkung
Soweit nach geltendem Recht zulässig, haftet der Autor Ihnen oder Dritten gegenüber in keinem Fall für direkte,
indirekte, zufällige, besondere, Folge- oder Strafschäden oder für den Verlust von Daten, Dateien, Modellen, Gewinnen,
Umsätzen, Geschäften, Verträgen, Geschäftswert oder erwarteten Einsparungen, für Betriebsunterbrechungen, Kosten für
Ersatzwaren oder -leistungen, Projektverzögerungen, Baumängel, Personenschäden, Sachschäden oder Schäden an Hardware,
Software oder Systemen — gleich aus welchem Grund und auf welcher Haftungsgrundlage, ob vertraglich, deliktisch
(einschließlich Fahrlässigkeit), verschuldensunabhängig oder anderweitig —, die sich aus dem Herunterladen, der
Installation, der Nutzung, dem Missbrauch oder der Unmöglichkeit der Nutzung der Software oder ihrer Ergebnisse
ergeben oder damit zusammenhängen, selbst wenn der Autor auf die Möglichkeit solcher Schäden hingewiesen wurde. Da die
Software kostenlos bereitgestellt wird, ist die Gesamthaftung des Autors, soweit die Haftung nicht vollständig
ausgeschlossen werden kann, auf den Betrag begrenzt, den Sie für die Software bezahlt haben, also null.
8. Keine fachliche Beratung
Die Software ist ein technisches Hilfsmittel. Sie bietet keine Ingenieur-, Architektur-, Tragwerks-, Brandschutz-,
Barrierefreiheits-, Energie-, Umwelt-, Kostenberatungs-, Rechts- oder sonstige fachliche Beratung und bescheinigt
nicht die Einhaltung von Bauvorschriften, Rechtsvorschriften, Normen oder Verträgen. Nichts, was die Software erzeugt,
ersetzt die Beurteilung, Prüfung und Freigabe durch eine entsprechend qualifizierte und zugelassene Fachperson.
9. Ergebnisse: keine Verantwortung, nicht für die Umsetzung in der Praxis
Der Autor übernimmt keinerlei Verantwortung für Ergebnisse, die von der Software erzeugt werden. Die
Ergebnisse sind für die Umsetzung in der Praxis nicht zuverlässig und dürfen nicht als Grundlage für reale
Planungs-, Bau-, Sicherheits-, Beschaffungs-, Finanz-, Rechts- oder sonstige Entscheidungen verwendet werden. Alle
Ausgaben der Software — insbesondere Geometrie, Mengen, Flächen, Volumen, Kosten, CO₂-Werte, Kollisionsergebnisse,
Terminpläne, Konformitäts- und Validierungsergebnisse, Brandschutz-, Flucht-, Tageslicht-, Akustik-, Wärme-, Solar-
und Tragwerksprüfungen sowie exportierte oder komprimierte Dateien — werden ausschließlich für die BIM-Ausbildung
erzeugt. Sie hängen vom Inhalt und von der Qualität der Eingabedateien, von Bibliotheken Dritter sowie von
vereinfachten Annahmen und Standardregeln der Software ab und können unvollständig, näherungsweise oder falsch sein.
Jedes Vertrauen auf sie erfolgt ausschließlich auf Ihr eigenes Risiko.
10. Ihre Dateien und Ihre Verantwortung
Sie allein sind verantwortlich für Ihre Nutzung der Software, für die Dateien, die Sie damit öffnen, verarbeiten,
konvertieren, komprimieren oder exportieren, sowie für vollständige und aktuelle Sicherungskopien all Ihrer Daten.
Arbeiten Sie stets mit Kopien wichtiger Dateien. Von der Software geschriebene Dateien, einschließlich komprimierter
oder konvertierter IFC-Dateien, können von den Originalen abweichen; es liegt in Ihrer Verantwortung, sie vor der
Verwendung zu prüfen. Sie sind dafür verantwortlich, dass Sie zur Nutzung jeder von Ihnen verarbeiteten Datei
berechtigt sind und dass Sie alle Gesetze, Vorschriften, Verträge und Rechte Dritter einhalten, die für Ihre Nutzung
der Software und ihrer Ergebnisse gelten.
11. Freistellung
Sie verpflichten sich, den Autor von allen Ansprüchen, Forderungen, Verlusten, Verbindlichkeiten, Schäden, Kosten und
Aufwendungen (einschließlich angemessener Anwaltskosten) freizustellen, ihn zu verteidigen und schadlos zu halten, die
von Dritten geltend gemacht werden oder die sich aus Ihrer Nutzung oder Ihrem Missbrauch der Software, aus damit
erzeugten Ergebnissen oder Dateien, aus Ihrem Verstoß gegen diese Bedingungen oder aus Ihrer Verletzung von Gesetzen
oder Rechten Dritter ergeben oder damit zusammenhängen.
12. Komponenten Dritter, Open-Source-Rechte und Lizenzhinweise
Die Software enthält Open-Source-Komponenten Dritter und Microsoft-Laufzeitumgebungen, die jeweils unter ihrer eigenen
Lizenz verwendet werden. Alle Rechte, die durch die Open-Source-Lizenzen der in den Werkzeugen verwendeten
Komponenten gewährt werden, bleiben uneingeschränkt gültig. Jede Komponente unterliegt weiterhin ihrer eigenen
Lizenz, und keine Bestimmung dieser Bedingungen beschränkt, ersetzt oder entzieht ein Recht, eine Erlaubnis oder eine
Pflicht, die diese Lizenz in Bezug auf die Komponente gewährt — einschließlich der Rechte, die Komponente selbst zu
nutzen, zu untersuchen, zu verändern und weiterzugeben sowie ihren Quellcode zu erhalten, soweit die Lizenz dies
vorsieht. Die Beschränkungen dieser Bedingungen gelten für das eigene Werk des Autors und für die Software als Ganzes,
nicht für diese Komponenten. Die Lizenzhinweise Dritter finden Sie in jeder Anwendung: Öffnen Sie das
Menü der Anwendung (oben links) und wählen Sie Third-party licenses. Diese Komponenten werden von ihren
jeweiligen Inhabern ohne Gewährleistung des Autors bereitgestellt; der Autor übernimmt dafür keine Verantwortung oder
Haftung.
13. Downloads und Sicherheit
Berechtigt sind nur Kopien, die von dieser Website bezogen oder vom Autor im Rahmen des IFCToolset Live Training
übergeben wurden (siehe Ziffer 2). Der Autor ist nicht verantwortlich für Kopien aus anderen Quellen oder für
Veränderungen, die Dritte an der Software vorgenommen haben. Obwohl angemessene Sorgfalt angewandt wird, gewährleistet
der Autor nicht, dass die Software oder diese Website frei von Viren oder anderen schädlichen Bestandteilen ist; es
liegt in Ihrer Verantwortung, heruntergeladene Dateien zu prüfen und Ihre Systeme zu schützen. Ihr Betriebssystem oder
Ihre Sicherheitssoftware kann vor Software unabhängiger Entwickler warnen; die Entscheidung, die Software auszuführen,
liegt bei Ihnen.
14. Kein Support und keine Updates

15. Lizenz und zulässige Nutzung
Die Software wird lizenziert, nicht verkauft. Sie ist Freeware für die BIM-Ausbildung: Sie dürfen sie im Rahmen der
Ziffern 1 bis 4 ausschließlich für die BIM-Aus- und Weiterbildung kostenlos nutzen. Jede kommerzielle oder geschäftliche
Nutzung ist untersagt. Die Software sowie sämtliche Urheber- und sonstigen Immaterialgüterrechte daran verbleiben im
ausschließlichen Eigentum des Autors. Alle Rechte, die in diesen Bedingungen nicht ausdrücklich eingeräumt werden, bleiben
dem Autor vorbehalten.
Die Software ist keine kommerzielle Software. Ihr Verkauf – oder die Erhebung eines Entgelts für sie, für eine Kopie oder für den Zugang zu ihr – ist strengstens untersagt. Die Software ist Closed Source: Ihr Quellcode wird weder veröffentlicht noch bereitgestellt, und es wird kein Recht eingeräumt, ihn zu erhalten, einzusehen, zu untersuchen oder daraus abzuleiten.
16. Datenschutz
Die Software läuft lokal auf Ihrem Computer und ist für den Offline-Betrieb ausgelegt; sie lädt Ihre Modelle oder
Dateien nicht hoch. Sie bleiben für die Sicherheit und Vertraulichkeit der Daten verantwortlich, die Sie damit
verarbeiten.
17. Hochrisikonutzung
Die Software ist nicht für eine Nutzung konzipiert, bestimmt oder zertifiziert, bei der ihr Versagen oder ein Fehler in
ihren Ergebnissen zu Tod, Personenschäden oder schweren physischen, Sach- oder Umweltschäden führen könnte. Jede solche
Nutzung erfolgt ausschließlich auf Ihr eigenes Risiko.
18. Anwendbares Recht, Gerichtsstand und salvatorische Klausel
Diese Bedingungen sowie alle Streitigkeiten oder Ansprüche, die sich aus oder im Zusammenhang mit der Software oder
diesen Bedingungen ergeben, unterliegen dem Recht der Republik Türkiye. Ausschließlich zuständig sind die
Gerichte und Vollstreckungsämter von İstanbul (İstanbul Mahkemeleri ve İcra Daireleri), deren Zuständigkeit
Sie sich unterwerfen. Soweit das Recht Ihres Landes den Ausschluss bestimmter Gewährleistungen oder die Beschränkung
bestimmter Haftungen nicht zulässt, gelten die obigen Ausschlüsse und Beschränkungen im größtmöglichen zulässigen

Der Autor kann diese Bedingungen jederzeit ändern, indem er eine aktualisierte Fassung auf dieser Website
veröffentlicht. Für ein Herunterladen oder eine Nutzung gilt die zu diesem Zeitpunkt gültige Fassung.
20. Annahme
Durch das Herunterladen oder die Nutzung der Software bestätigen Sie, dass Sie diese Bedingungen gelesen, verstanden
und angenommen haben und die Software ausschließlich auf Ihr eigenes Risiko nutzen.
21. Sprachfassungen
Diese Bedingungen werden in Englisch, Türkisch, Französisch, Deutsch, Italienisch und Spanisch veröffentlicht. Bei
Abweichungen oder Auslegungsunterschieden zwischen den Sprachfassungen ist die türkische Fassung
maßgeblich.

quedar vinculado por ellas. Si no las acepta, no descargue ni utilice el Software.
El Software se proporciona únicamente con fines de formación en BIM y no puede utilizarse en ninguna
aplicación comercial o empresarial. El Autor no asume ninguna responsabilidad por los resultados que produce, los
cuales no son fiables para su aplicación en la vida real. Las aplicaciones distintas de Orinel★ mini solo pueden ser
utilizadas por los alumnos del IFCToolset Live Training. La distribución del Software a terceros, su ingeniería
inversa o su pirateo están estrictamente prohibidos y serán perseguidos ante los tribunales de İstanbul, República de
Türkiye.
1. Uso exclusivo para la formación en BIM
El Software se pone a disposición exclusivamente para la educación y la formación en el Modelado de
Información de Construcción (BIM) — para el aprendizaje, la enseñanza y los ejercicios académicos no
comerciales. No puede utilizarse, total o parcialmente, en ninguna aplicación comercial o empresarial, incluidos, entre
otros, los trabajos remunerados o profesionales de diseño, ingeniería, consultoría, construcción, gestión de
instalaciones (facility management), estimación de costes o verificación de cumplimiento normativo, los trabajos
realizados para un cliente o empleador, o cualquier producto o servicio ofrecido a cambio de una contraprestación.
Cualquier uso fuera de la formación en BIM no está amparado por la licencia, constituye un incumplimiento de estas
condiciones y se realiza exclusivamente bajo su propio riesgo.
2. Usuarios autorizados y copias autorizadas
Orinel★ mini puede descargarse de este sitio web y ser utilizado por cualquier persona para la formación en BIM,
con sujeción a estas condiciones. Todas las demás aplicaciones de IFCToolset solo pueden ser utilizadas por
alumnos inscritos en el IFCToolset Live Training o que lo hayan completado, y únicamente en virtud de la
licencia personal, no exclusiva, intransferible y revocable que el Autor les haya otorgado. Solo pueden
utilizarse las copias obtenidas directamente de este sitio web o entregadas directamente por el Autor en el IFCToolset
Live Training. Las copias obtenidas de cualquier otra fuente no están autorizadas; su uso está prohibido y

3. Prohibición de distribución a terceros

sitios web, redes, soportes extraíbles o mensajería —, ya sea a título oneroso o gratuito. Cada copia se licencia
únicamente a su usuario. Cualquier distribución constituye una infracción de los derechos de autor del Autor y de
estas condiciones.
4. Prohibición de ingeniería inversa, pirateo y manipulación
No puede, ni puede intentar, realizar ingeniería inversa, descompilar, desensamblar, descifrar, piratear
(crack), parchear, modificar, adaptar el Software ni crear obras derivadas del mismo, ni extraer su código
fuente, sus algoritmos o su estructura interna; eliminar, eludir, desactivar o burlar cualquier comprobación de
licencia, restricción de uso, límite de tamaño de archivo, medida de protección o limitación técnica; ni eliminar o
alterar cualquier aviso de derechos de autor, licencia, marca o atribución. Esta cláusula se aplica al código propio
del Autor y al Software en su conjunto; no restringe ningún derecho que la licencia de un componente de código
abierto incluido otorgue respecto de dicho componente (véase la cláusula 12).
5. Acciones legales
El Software está protegido por la legislación de la República de Türkiye en materia de derechos de autor y
propiedad intelectual, incluida la Ley n.º 5846 sobre Obras Intelectuales y Artísticas, así como por los tratados
internacionales. Cualquier uso no autorizado, distribución, ingeniería inversa, pirateo, manipulación u otro

incumplimiento pone fin a su licencia de forma inmediata y automática, sin previo aviso; tras la terminación, deberá
dejar de utilizar el Software y destruir todas las copias en su poder. La terminación no afecta al derecho del Autor
a reclamar daños y perjuicios por el incumplimiento.
6. Ausencia de garantía
El Software se proporciona «tal cual» y «según disponibilidad», con todos sus defectos y sin
garantía de ningún tipo. En la máxima medida permitida por la ley aplicable, el autor, Ümit Işıkdağ, y todos los
titulares de derechos de autor (conjuntamente, «el Autor») excluyen toda garantía, expresa, implícita, legal o de otro
tipo, incluidas, entre otras, las garantías de comerciabilidad, idoneidad para un fin determinado, titularidad, no
infracción, exactitud, integridad, fiabilidad, disfrute pacífico, integración de sistemas y ausencia de errores,
defectos, virus u otros componentes dañinos. El Autor no garantiza que el Software satisfaga sus necesidades, funcione
sin interrupciones, sea compatible con su hardware, software o archivos, ni que se corrijan los defectos. Ningún
consejo o información, oral o escrita, obtenida del Autor o a través de este sitio web crea garantía alguna que no
esté expresamente prevista en estas condiciones.
7. Limitación de responsabilidad
En la máxima medida permitida por la ley aplicable, el Autor no será responsable en ningún caso ante usted ni ante
terceros por daños directos, indirectos, incidentales, especiales, consecuentes, ejemplares o punitivos, ni por la
pérdida de datos, archivos, modelos, beneficios, ingresos, negocio, contratos, fondo de comercio o ahorros previstos,
la interrupción de la actividad, el coste de bienes o servicios sustitutivos, los retrasos de proyectos, los defectos
de construcción, las lesiones personales, los daños materiales o los daños al hardware, software o sistemas,
cualquiera que sea su causa y el fundamento de la responsabilidad — contractual, extracontractual (incluida la
negligencia), objetiva o de otro tipo —, que se deriven de la descarga, instalación, uso, uso indebido o imposibilidad
de uso del Software o de cualquier resultado que produzca, o que estén relacionados con ellos, incluso si se hubiera
advertido al Autor de la posibilidad de tales daños. Dado que el Software se proporciona de forma gratuita, cuando la
responsabilidad no pueda excluirse por completo, la responsabilidad total acumulada del Autor no excederá del importe
que usted haya pagado por el Software, es decir, cero.
8. No constituye asesoramiento profesional
El Software es una ayuda técnica. No proporciona asesoramiento de ingeniería, arquitectura, estructuras, seguridad
contra incendios, accesibilidad, energía, medio ambiente, consultoría de costes, jurídico ni ningún otro
asesoramiento profesional, y no certifica el cumplimiento de ningún código técnico de edificación, reglamento, norma o
contrato. Nada de lo que produce el Software sustituye el criterio, la revisión y la aprobación de un profesional
debidamente cualificado y habilitado.
9. Resultados: sin responsabilidad, no aptos para su aplicación real
El Autor no asume responsabilidad alguna por ningún resultado producido por el Software. Los resultados no
son fiables para su aplicación en la vida real y no deben utilizarse como base de ninguna decisión real de
diseño, construcción, seguridad, contratación, financiera, jurídica o de otro tipo. Todos los resultados del Software
— incluidos, entre otros, la geometría, las cantidades, las superficies, los volúmenes, los costes, los valores de
carbono, los resultados de detección de interferencias, los cronogramas, los resultados de cumplimiento y validación,
las comprobaciones de incendios, evacuación, iluminación natural, acústica, térmica, solar y estructural, así como
cualquier archivo exportado o comprimido — se producen únicamente para la formación en BIM. Dependen del contenido y
de la calidad de los archivos de entrada, de bibliotecas de terceros y de supuestos simplificados y reglas
predeterminadas integradas en el Software, y pueden ser incompletos, aproximados o erróneos. Cualquier confianza en
ellos se deposita exclusivamente bajo su propio riesgo.
10. Sus archivos y su responsabilidad
Usted es el único responsable del uso que haga del Software, de los archivos que abra, procese, convierta, comprima
o exporte con él, y de mantener copias de seguridad completas y actualizadas de todos sus datos. Trabaje siempre con
copias de los archivos importantes. Los archivos escritos por el Software, incluidos los archivos IFC comprimidos o
convertidos, pueden diferir de los originales; es su responsabilidad comprobarlos antes de utilizarlos. Usted es
responsable de asegurarse de que tiene derecho a utilizar cualquier archivo que procese y de cumplir todas las leyes,
reglamentos, contratos y derechos de terceros aplicables a su uso del Software y de sus resultados.
11. Indemnización
Usted se compromete a indemnizar, defender y mantener indemne al Autor frente a cualquier reclamación, demanda,
pérdida, responsabilidad, daño, coste y gasto (incluidos honorarios razonables de abogados) presentado por cualquier
tercero o que se derive de o esté relacionado con su uso o uso indebido del Software, cualquier resultado o archivo
producido con él, su incumplimiento de estas condiciones o su infracción de cualquier ley o de los derechos de
terceros.
12. Componentes de terceros, derechos de código abierto y avisos de licencia
El Software incluye componentes de código abierto de terceros y entornos de ejecución de Microsoft, cada uno
utilizado bajo su propia licencia. Todos los derechos otorgados por las licencias de código abierto de los
componentes utilizados en las herramientas siguen siendo plenamente válidos. Cada componente sigue sujeto a
su propia licencia, y nada de lo dispuesto en estas condiciones limita, sustituye ni suprime ningún derecho, permiso u
obligación que dicha licencia otorgue respecto de ese componente — incluidos los derechos de usar, estudiar, modificar
y redistribuir el propio componente y de obtener su código fuente cuando la licencia lo prevea. Las restricciones de
estas condiciones se aplican a la obra propia del Autor y al Software en su conjunto, no a dichos componentes.
Los avisos de licencia de terceros se encuentran dentro de cada aplicación: abra el menú de la
aplicación (arriba a la izquierda) y elija Third-party licenses. Dichos componentes son proporcionados por
sus respectivos titulares sin garantía alguna por parte del Autor, que no asume ninguna responsabilidad respecto de
ellos.
13. Descargas y seguridad
Solo están autorizadas las copias obtenidas de este sitio web o entregadas por el Autor en el IFCToolset Live
Training (véase la cláusula 2). El Autor no es responsable de las copias obtenidas de cualquier otra fuente ni de las
modificaciones introducidas en el Software por terceros. Aunque se actúa con una diligencia razonable, el Autor no
garantiza que el Software o este sitio web estén libres de virus u otros componentes dañinos; es su responsabilidad
analizar los archivos descargados y proteger sus sistemas. Su sistema operativo o su software de seguridad pueden
mostrar advertencias sobre el software de desarrolladores independientes; la decisión de ejecutar el Software es

14. Sin soporte ni actualizaciones

condiciones pueden modificarse, suspenderse o interrumpirse en cualquier momento sin previo aviso.
15. Licencia y uso permitido
El Software se licencia, no se vende. Es software gratuito para la formación en BIM: puede utilizarlo de forma
gratuita exclusivamente para la educación y la formación en BIM, dentro de los límites de las cláusulas 1 a 4. Queda
prohibido cualquier uso comercial o empresarial. El Software y todos los derechos de autor y demás derechos de
propiedad intelectual sobre él siguen siendo propiedad exclusiva del Autor. Todos los derechos no otorgados
expresamente en estas condiciones quedan reservados al Autor.
El Software no es un software comercial. Su venta —o el cobro de cualquier importe por el Software, por una copia o por el acceso a él— está estrictamente prohibida. El Software es de código cerrado: su código fuente no se publica ni se facilita, y no se concede ningún derecho a obtenerlo, verlo, examinarlo o derivar obras de él.
16. Privacidad
El Software se ejecuta localmente en su ordenador y está diseñado para funcionar sin conexión; no sube sus modelos
ni sus archivos. Usted sigue siendo responsable de la seguridad y la confidencialidad de los datos que procesa con
él.
17. Uso de alto riesgo
El Software no está diseñado, destinado ni certificado para usos en los que su fallo, o un error en sus resultados,
pueda provocar la muerte, lesiones personales o daños físicos, materiales o medioambientales graves. Cualquier uso de
este tipo se realiza exclusivamente bajo su propio riesgo.
18. Legislación aplicable, jurisdicción y divisibilidad
Estas condiciones, así como cualquier controversia o reclamación derivada del Software o de estas condiciones o
relacionada con ellos, se rigen por la legislación de la República de Türkiye. Los tribunales y las oficinas
de ejecución de İstanbul (İstanbul Mahkemeleri ve İcra Daireleri) tienen competencia exclusiva, a la cual
usted se somete. Cuando la legislación de su país no permita la exclusión de determinadas garantías o la limitación
de determinadas responsabilidades, las exclusiones y limitaciones anteriores se aplicarán en la máxima medida

19. Modificaciones de estas condiciones
El Autor puede revisar estas condiciones en cualquier momento publicando una versión actualizada en este sitio web.
A cada descarga o uso del Software se aplica la versión vigente en el momento de dicha descarga o uso.
20. Aceptación
Al descargar o utilizar el Software, usted confirma que ha leído, comprendido y aceptado estas condiciones y que
utiliza el Software exclusivamente bajo su propio riesgo.
21. Versiones lingüísticas
Estas condiciones se publican en inglés, turco, francés, alemán, italiano y español. En caso de discrepancia o de
diferencia de interpretación entre las versiones lingüísticas, prevalecerá la versión turca.

utilisation en dehors de l’enseignement du BIM n’est pas autorisée par la licence, constitue une violation des
présentes conditions et s’effectue entièrement à vos propres risques.
2. Utilisateurs autorisés et copies autorisées
Orinel★ mini peut être téléchargé sur ce site et utilisé par toute personne à des fins d’enseignement du BIM,
sous réserve des présentes conditions. Toutes les autres applications IFCToolset ne peuvent être utilisées
que par les étudiants inscrits à la formation IFCToolset Live Training ou l’ayant suivie, et uniquement dans
le cadre de la licence personnelle, non exclusive, non transférable et révocable que l’Auteur leur a concédée.
Seules peuvent être utilisées les copies obtenues directement sur ce site ou remises directement par
l’Auteur lors de la formation IFCToolset Live Training. Les copies obtenues de toute autre source ne sont
pas autorisées ; leur utilisation est interdite et constitue une atteinte aux droits de l’Auteur.
3. Interdiction de distribution à des tiers
La distribution du Logiciel à des tiers est strictement interdite et illicite. Vous ne pouvez pas
copier, partager, publier, téléverser, mettre en miroir, héberger, transmettre, prêter, donner, vendre, louer,
concéder en sous-licence ou mettre à disposition de toute autre manière le Logiciel, toute partie de celui-ci, ou
toute licence ou tout accès à celui-ci, à toute autre personne ou organisation, par quelque moyen que ce soit — y
compris les services de partage de fichiers, les sites web, les réseaux, les supports amovibles ou la messagerie —
que ce soit à titre onéreux ou gratuit. Chaque copie est concédée sous licence à son seul utilisateur. Toute

4. Interdiction d’ingénierie inverse, de piratage et d’altération
Vous ne pouvez pas, ni tenter de, procéder à l’ingénierie inverse, décompiler, désassembler, déchiffrer,
pirater, modifier par correctif, modifier, adapter le Logiciel ou en créer des œuvres dérivées, ni en
extraire le code source, les algorithmes ou la structure interne ; supprimer, contourner, désactiver ou neutraliser
tout contrôle de licence, toute restriction d’utilisation, toute limite de taille de fichier, toute mesure de
protection ou toute limitation technique ; ni supprimer ou modifier toute mention de droit d’auteur, de licence, de
marque ou d’attribution. Cette clause s’applique au code propre de l’Auteur et au Logiciel dans son ensemble ; elle
ne restreint aucun droit que la licence d’un composant open source inclus accorde à l’égard de ce composant (voir
l’article 12).
5. Actions en justice
Le Logiciel est protégé par la législation de la République de Türkiye relative au droit d’auteur et à la propriété
intellectuelle, notamment la loi n° 5846 sur les œuvres intellectuelles et artistiques, ainsi que par les traités
internationaux. Toute utilisation non autorisée, distribution, ingénierie inverse, piratage, altération ou
autre violation des présentes conditions fera l’objet de poursuites par l’Auteur dans toute la mesure permise par la
loi, devant les tribunaux d’İstanbul, République de Türkiye. L’Auteur se réserve et exercera toutes les
voies de recours civiles et pénales disponibles, y compris, sans s’y limiter, les injonctions et mesures provisoires,
la saisie et la destruction des copies contrefaisantes et des moyens utilisés pour les réaliser, les demandes de
dommages-intérêts matériels et moraux et de restitution des bénéfices réalisés par le contrefacteur, les plaintes
pénales auprès du procureur compétent et la publication des décisions de justice. Le contrevenant supportera tous les

soit le fondement de la responsabilité — contractuelle, délictuelle (y compris la négligence), objective ou autre —
découlant du téléchargement, de l’installation, de l’utilisation, de la mauvaise utilisation ou de l’impossibilité
d’utiliser le Logiciel ou tout résultat qu’il produit, ou en lien avec ceux-ci, même si l’Auteur a été informé de la
possibilité de tels dommages. Le Logiciel étant fourni gratuitement, lorsque la responsabilité ne peut être
entièrement exclue, la responsabilité totale cumulée de l’Auteur ne pourra excéder le montant que vous avez payé
pour le Logiciel, soit zéro.
8. Absence de conseil professionnel
Le Logiciel est une aide technique. Il ne fournit aucun conseil d’ingénierie, d’architecture, de structure, de
sécurité incendie, d’accessibilité, d’énergie, d’environnement, d’économie de la construction, juridique ou tout
autre conseil professionnel, et ne certifie la conformité à aucune réglementation de construction, norme ou contrat.
Rien de ce que produit le Logiciel ne remplace le jugement, la vérification et la validation d’un professionnel
dûment qualifié et habilité.
9. Résultats : aucune responsabilité, pas pour une mise en œuvre réelle
L’Auteur décline toute responsabilité, de quelque nature que ce soit, quant aux résultats produits par le
Logiciel. Les résultats ne sont pas fiables pour une mise en œuvre réelle et ne doivent servir de base à
aucune décision réelle de conception, de construction, de sécurité, d’achat, financière, juridique ou autre. Tous
les résultats du Logiciel — y compris, sans s’y limiter, la géométrie, les quantités, les surfaces, les volumes, les
coûts, les valeurs carbone, les résultats de détection de conflits, les plannings, les résultats de conformité et de
validation, les contrôles incendie, d’évacuation, d’éclairage naturel, acoustiques, thermiques, solaires et
structurels, ainsi que tout fichier exporté ou compressé — sont produits uniquement pour l’enseignement du BIM. Ils
dépendent du contenu et de la qualité des fichiers d’entrée, de bibliothèques tierces et d’hypothèses simplifiées et
de règles par défaut intégrées au Logiciel, et peuvent être incomplets, approximatifs ou erronés. Tout recours à ces
résultats s’effectue entièrement à vos propres risques.
10. Vos fichiers et votre responsabilité
Vous êtes seul responsable de votre utilisation du Logiciel, des fichiers que vous ouvrez, traitez, convertissez,
compressez ou exportez avec celui-ci, ainsi que de la conservation de sauvegardes complètes et à jour de toutes vos
données. Travaillez toujours sur des copies des fichiers importants. Les fichiers écrits par le Logiciel, y compris les
fichiers IFC compressés ou convertis, peuvent différer des originaux ; il vous incombe de les vérifier avant
utilisation. Il vous incombe de vous assurer que vous disposez du droit d’utiliser tout fichier que vous traitez et
de respecter l’ensemble des lois, réglementations, contrats et droits des tiers applicables à votre utilisation du
Logiciel et de ses résultats.
11. Garantie et indemnisation
Vous acceptez d’indemniser, de défendre et de garantir l’Auteur contre toute réclamation, demande, perte,
responsabilité, dommage, frais et dépense (y compris des honoraires d’avocat raisonnables) formés par un tiers ou
découlant de votre utilisation ou mauvaise utilisation du Logiciel, de tout résultat ou fichier produit avec
celui-ci, de votre violation des présentes conditions ou de votre violation de toute loi ou des droits d’un tiers,
ou s’y rapportant.
12. Composants tiers, droits open source et mentions de licence
Le Logiciel comprend des composants open source de tiers et des environnements d’exécution Microsoft, chacun
utilisé sous sa propre licence. Tous les droits accordés par les licences open source des composants utilisés
dans les outils restent pleinement valables. Chaque composant reste soumis à sa propre licence, et aucune
disposition des présentes conditions ne limite, ne remplace ni ne supprime un droit, une autorisation ou une

restrictions des présentes conditions s’appliquent à l’œuvre propre de l’Auteur et au Logiciel dans son ensemble, et
non à ces composants. Les mentions de licence des composants tiers se trouvent dans chaque
application : ouvrez le menu de l’application (en haut à gauche) et choisissez Third-party licenses.
Ces composants sont fournis par leurs propriétaires respectifs sans garantie de la part de l’Auteur, qui décline toute

13. Téléchargements et sécurité
Seules les copies obtenues sur ce site ou remises par l’Auteur lors de la formation IFCToolset Live Training sont
autorisées (voir l’article 2). L’Auteur n’est pas responsable des copies obtenues de toute autre source, ni de toute
modification apportée au Logiciel par un tiers. Bien qu’une diligence raisonnable soit exercée, l’Auteur ne garantit
pas que le Logiciel ou ce site soient exempts de virus ou d’autres composants nuisibles ; il vous appartient
d’analyser les fichiers téléchargés et de protéger vos systèmes. Votre système d’exploitation ou votre logiciel de
sécurité peut afficher un avertissement concernant les logiciels de développeurs indépendants ; la décision
d’exécuter le Logiciel vous appartient.
14. Absence d’assistance et de mises à jour
L’Auteur n’est tenu à aucune obligation de fournir une assistance, une maintenance, des mises à jour, des
corrections ou de nouvelles versions du Logiciel, ni de maintenir le Logiciel ou ce site disponibles. Le Logiciel,
ses fonctionnalités et les présentes conditions peuvent être modifiés, suspendus ou abandonnés à tout moment et sans
préavis.
15. Licence et utilisation autorisée
Le Logiciel est concédé sous licence et non vendu. Il s’agit d’un logiciel gratuit destiné à l’enseignement du
BIM : vous pouvez l’utiliser gratuitement à des fins d’enseignement et de formation au BIM uniquement, dans les
limites des articles 1 à 4. Toute utilisation commerciale ou professionnelle, de quelque nature que ce soit, est
interdite. Le Logiciel ainsi que l’ensemble des droits d’auteur et autres droits de propriété intellectuelle qui s’y
rattachent demeurent la propriété exclusive de l’Auteur. Tous les droits qui ne sont pas expressément accordés par
les présentes conditions sont réservés par l’Auteur.
Le Logiciel n’est pas un logiciel commercial. Sa vente — ou la perception de toute somme pour le Logiciel, pour une copie de celui-ci ou pour l’accès à celui-ci — est strictement interdite. Le Logiciel est à code source fermé : son code source n’est ni publié ni fourni, et aucun droit de l’obtenir, de le consulter, de l’examiner ou d’en dériver n’est accordé.
16. Confidentialité
Le Logiciel s’exécute localement sur votre ordinateur et est conçu pour fonctionner hors ligne ; il ne téléverse
pas vos modèles ni vos fichiers. Vous restez responsable de la sécurité et de la confidentialité des données que vous
traitez avec celui-ci.
17. Utilisation à haut risque
Le Logiciel n’est ni conçu, ni destiné, ni certifié pour une utilisation dans laquelle sa défaillance ou une erreur
dans ses résultats pourrait entraîner la mort, des dommages corporels ou de graves dommages physiques, matériels ou
environnementaux. Toute utilisation de ce type s’effectue entièrement à vos propres risques.
18. Droit applicable, juridiction compétente et divisibilité
Les présentes conditions, ainsi que tout litige ou toute réclamation découlant du Logiciel ou des présentes
conditions ou s’y rapportant, sont régis par le droit de la République de Türkiye. Les tribunaux et bureaux
d’exécution d’İstanbul (İstanbul Mahkemeleri ve İcra Daireleri) ont compétence exclusive, et vous vous
soumettez à cette compétence. Lorsque le droit de votre pays n’autorise pas l’exclusion de certaines garanties ou la
limitation de certaines responsabilités, les exclusions et limitations ci-dessus s’appliquent dans toute la mesure

Il Software è fornito esclusivamente per finalità di formazione BIM e non può essere utilizzato in alcuna
applicazione commerciale o professionale. L’Autore non si assume alcuna responsabilità per i risultati che esso
produce, i quali non sono affidabili per un’applicazione reale. Le applicazioni diverse da Orinel★ mini possono
essere utilizzate esclusivamente dagli studenti dell’IFCToolset Live Training. La distribuzione del Software a terzi,
il suo reverse engineering o la sua violazione (cracking) sono severamente vietati e saranno perseguiti dinanzi ai
tribunali di İstanbul, Repubblica di Türkiye.
1. Uso esclusivamente per la formazione BIM

qualsiasi prodotto o servizio offerto a pagamento. Qualsiasi uso al di fuori della formazione BIM non è concesso in
licenza, costituisce una violazione delle presenti condizioni ed è interamente a rischio dell’utente.
2. Utenti autorizzati e copie autorizzate
Orinel★ mini può essere scaricato da questo sito web e utilizzato da chiunque per la formazione BIM, nel rispetto
delle presenti condizioni. Tutte le altre applicazioni IFCToolset possono essere utilizzate esclusivamente dagli
studenti iscritti all’IFCToolset Live Training o che lo hanno completato, e solo nell’ambito della licenza
personale, non esclusiva, non trasferibile e revocabile loro concessa dall’Autore. Possono essere utilizzate
solo le copie ottenute direttamente da questo sito web o consegnate direttamente dall’Autore durante l’IFCToolset Live
Training. Le copie ottenute da qualsiasi altra fonte non sono autorizzate; il loro utilizzo è vietato e
costituisce violazione dei diritti dell’Autore.
3. Divieto di distribuzione a terzi
La distribuzione del Software a terzi è severamente vietata e illecita. L’utente non può copiare,
condividere, pubblicare, caricare, replicare (mirror), ospitare, trasmettere, prestare, cedere gratuitamente, vendere,
noleggiare, concedere in locazione, concedere in sublicenza o rendere altrimenti disponibile il Software, qualsiasi sua

servizi di condivisione di file, siti web, reti, supporti rimovibili o messaggistica — sia a titolo oneroso sia
gratuito. Ogni copia è concessa in licenza al solo utente. Qualsiasi distribuzione costituisce violazione del diritto
d’autore dell’Autore e delle presenti condizioni.
4. Divieto di reverse engineering, cracking e manomissione
L’utente non può, né può tentare di, effettuare il reverse engineering, decompilare, disassemblare,
decifrare, violare (crack), modificare tramite patch, modificare, adattare il Software o crearne opere
derivate, né estrarne il codice sorgente, gli algoritmi o la struttura interna; rimuovere, aggirare,
disattivare o eludere qualsiasi controllo di licenza, restrizione d’uso, limite di dimensione dei file, misura di
protezione o limitazione tecnica; né rimuovere o alterare qualsiasi avviso di diritto d’autore, licenza, marchio o
attribuzione. La presente clausola si applica al codice proprio dell’Autore e al Software nel suo complesso; non limita
alcun diritto che la licenza di un componente open source incluso conceda in relazione a tale componente (vedere
l’articolo 12).
5. Azioni legali
Il Software è tutelato dalla normativa della Repubblica di Türkiye in materia di diritto d’autore e proprietà
intellettuale, compresa la Legge n. 5846 sulle opere intellettuali e artistiche, nonché dai trattati internazionali.
Qualsiasi uso non autorizzato, distribuzione, reverse engineering, cracking, manomissione o altra violazione
delle presenti condizioni sarà perseguito dall’Autore nella misura massima consentita dalla legge, dinanzi ai tribunali
di İstanbul, Repubblica di Türkiye. L’Autore si riserva ed eserciterà ogni rimedio civile e penale
disponibile, inclusi a titolo esemplificativo provvedimenti inibitori e misure cautelari, il sequestro e la distruzione
delle copie contraffatte e dei mezzi utilizzati per realizzarle, le richieste di risarcimento del danno patrimoniale e
non patrimoniale e di restituzione degli utili conseguiti dal contraffattore, le denunce penali alla procura
competente e la pubblicazione delle decisioni giudiziarie. Il trasgressore sosterrà tutti i costi sostenuti dall’Autore
per accertare, indagare e agire in relazione alla violazione, comprese le spese giudiziali e gli onorari legali.
Qualsiasi violazione determina la cessazione immediata e automatica della licenza, senza preavviso; in caso di
cessazione l’utente deve interrompere l’uso del Software e distruggere tutte le copie in suo possesso. La cessazione non
pregiudica il diritto dell’Autore di chiedere il risarcimento dei danni per la violazione.
6. Esclusione di garanzia
Il Software è fornito “così com’è” e “come disponibile”, con tutti i suoi difetti e senza garanzia di
alcun tipo. Nella misura massima consentita dalla legge applicabile, l’autore, Ümit Işıkdağ, e tutti i titolari dei
diritti d’autore (congiuntamente “l’Autore”) escludono qualsiasi garanzia, espressa, implicita, legale o di altro tipo,
incluse a titolo esemplificativo le garanzie di commerciabilità, idoneità a uno scopo particolare, titolarità, non
violazione, accuratezza, completezza, affidabilità, pacifico godimento, integrazione di sistema e assenza di errori,
difetti, virus o altri componenti dannosi. L’Autore non garantisce che il Software soddisfi le esigenze dell’utente,
funzioni senza interruzioni, sia compatibile con il suo hardware, software o file, né che i difetti vengano corretti.
Nessun consiglio o informazione, orale o scritta, ottenuta dall’Autore o tramite questo sito web crea alcuna garanzia
non espressamente prevista dalle presenti condizioni.
7. Limitazione di responsabilità
Nella misura massima consentita dalla legge applicabile, in nessun caso l’Autore sarà responsabile nei confronti
dell’utente o di terzi per danni diretti, indiretti, incidentali, speciali, consequenziali, esemplari o punitivi, né per
perdita di dati, file, modelli, profitti, ricavi, attività, contratti, avviamento o risparmi attesi, interruzione
dell’attività, costi di beni o servizi sostitutivi, ritardi di progetto, difetti di costruzione, lesioni personali,
danni a cose o danni a hardware, software o sistemi, comunque causati e in base a qualsiasi titolo di responsabilità —
contrattuale, extracontrattuale (inclusa la negligenza), oggettiva o altro — derivanti da o connessi al download,
all’installazione, all’uso, all’uso improprio o all’impossibilità di utilizzare il Software o i risultati da esso
prodotti, anche qualora l’Autore sia stato informato della possibilità di tali danni. Poiché il Software è fornito
gratuitamente, qualora la responsabilità non possa essere esclusa del tutto, la responsabilità complessiva dell’Autore
non potrà superare l’importo pagato dall’utente per il Software, ossia zero.
8. Nessuna consulenza professionale
Il Software è un ausilio tecnico. Non fornisce consulenza ingegneristica, architettonica, strutturale, antincendio, in
materia di accessibilità, energia, ambiente, stima dei costi, legale o di altro tipo professionale, e non certifica la
conformità ad alcuna normativa edilizia, regolamento, norma tecnica o contratto. Nulla di quanto prodotto dal Software
sostituisce il giudizio, la verifica e l’approvazione di un professionista adeguatamente qualificato e abilitato.
9. Risultati: nessuna responsabilità, non per un’applicazione reale
L’Autore non si assume alcuna responsabilità per qualsiasi risultato prodotto dal Software. I risultati non
sono affidabili per un’applicazione reale e non devono essere utilizzati come base per alcuna decisione reale
di progettazione, costruzione, sicurezza, approvvigionamento, finanziaria, legale o di altro tipo. Tutti gli output del
Software — inclusi a titolo esemplificativo geometria, quantità, superfici, volumi, costi, valori di carbonio,
risultati di clash detection, cronoprogrammi, risultati di conformità e validazione, verifiche antincendio, di esodo,
di illuminazione naturale, acustiche, termiche, solari e strutturali, nonché qualsiasi file esportato o compresso —
sono prodotti esclusivamente per la formazione BIM. Dipendono dal contenuto e dalla qualità dei file di input, da
librerie di terze parti e da ipotesi semplificate e regole predefinite integrate nel Software, e possono essere
incompleti, approssimativi o errati. Qualsiasi affidamento su di essi avviene interamente a rischio dell’utente.
10. I tuoi file e la tua responsabilità
L’utente è l’unico responsabile dell’uso del Software, dei file che apre, elabora, converte, comprime o esporta con
esso, e della conservazione di backup completi e aggiornati di tutti i propri dati. Lavorare sempre su copie dei file
importanti. I file scritti dal Software, inclusi i file IFC compressi o convertiti, possono differire dagli originali;
è responsabilità dell’utente verificarli prima dell’uso. L’utente è responsabile di assicurarsi di avere il diritto di
utilizzare ogni file che elabora e di rispettare tutte le leggi, i regolamenti, i contratti e i diritti di terzi
applicabili al proprio uso del Software e dei suoi risultati.
11. Manleva
L’utente si impegna a manlevare, difendere e tenere indenne l’Autore da qualsiasi pretesa, richiesta, perdita,
responsabilità, danno, costo e spesa (inclusi ragionevoli onorari legali) avanzati da terzi o derivanti da o connessi
all’uso o all’uso improprio del Software, a qualsiasi risultato o file prodotto con esso, alla violazione delle
presenti condizioni o alla violazione di qualsiasi legge o diritto di terzi.
12. Componenti di terze parti, diritti open source e avvisi di licenza
Il Software include componenti open source di terze parti e runtime Microsoft, ciascuno utilizzato in base alla
propria licenza. Tutti i diritti concessi dalle licenze open source dei componenti utilizzati negli strumenti
restano pienamente validi. Ogni componente resta soggetto alla propria licenza e nessuna disposizione delle
presenti condizioni limita, sostituisce o sopprime alcun diritto, permesso od obbligo che tale licenza conceda in
relazione a quel componente — inclusi i diritti di utilizzare, studiare, modificare e ridistribuire il componente
stesso e di ottenerne il codice sorgente ove la licenza lo preveda. Le restrizioni delle presenti condizioni si
applicano all’opera propria dell’Autore e al Software nel suo complesso, non a tali componenti. Gli avvisi di
licenza di terze parti si trovano all’interno di ciascuna applicazione: aprire il menu dell’applicazione (in
alto a sinistra) e scegliere Third-party licenses. Tali componenti sono forniti dai rispettivi titolari senza
alcuna garanzia da parte dell’Autore, che non si assume alcuna responsabilità al riguardo.
13. Download e sicurezza
Sono autorizzate soltanto le copie ottenute da questo sito web o consegnate dall’Autore durante l’IFCToolset Live
Training (vedere l’articolo 2). L’Autore non è responsabile delle copie ottenute da altre fonti né di eventuali
modifiche apportate al Software da terzi. Pur adottando una ragionevole diligenza, l’Autore non garantisce che il

Il Software non è un software commerciale. La sua vendita — o la richiesta di qualsiasi corrispettivo per il Software, per una sua copia o per l’accesso ad esso — è severamente vietata. Il Software è a codice sorgente chiuso: il codice sorgente non è pubblicato né fornito, e non è concesso alcun diritto di ottenerlo, visualizzarlo, esaminarlo o derivarne opere.
16. Riservatezza
Il Software viene eseguito localmente sul computer dell’utente ed è progettato per funzionare offline; non carica i
modelli o i file dell’utente. L’utente resta responsabile della sicurezza e della riservatezza dei dati che elabora
con esso.
17. Uso ad alto rischio
Il Software non è progettato, destinato né certificato per usi in cui un suo malfunzionamento o un errore nei suoi
risultati possa causare morte, lesioni personali o gravi danni fisici, materiali o ambientali. Qualsiasi uso di
questo tipo avviene interamente a rischio dell’utente.
18. Legge applicabile, foro competente e clausola di salvaguardia
Le presenti condizioni, nonché qualsiasi controversia o pretesa derivante da o connessa al Software o alle presenti
condizioni, sono disciplinate dalla legge della Repubblica di Türkiye. I tribunali e gli uffici esecutivi di
İstanbul (İstanbul Mahkemeleri ve İcra Daireleri) hanno competenza esclusiva, alla quale l’utente si
sottomette. Laddove la legge del paese dell’utente non consenta l’esclusione di determinate garanzie o la limitazione
di determinate responsabilità, le esclusioni e le limitazioni di cui sopra si applicano nella misura massima
consentita. Qualora una disposizione delle presenti condizioni sia ritenuta invalida o inapplicabile, essa sarà
applicata nella misura massima consentita e le restanti disposizioni resteranno pienamente valide ed efficaci.
19. Modifiche alle presenti condizioni

20. Accettazione
Scaricando o utilizzando il Software, l’utente conferma di aver letto, compreso e accettato le presenti condizioni e
di utilizzare il Software interamente a proprio rischio.
21. Versioni linguistiche
Le presenti condizioni sono pubblicate in inglese, turco, francese, tedesco, italiano e spagnolo. In caso di
discrepanza o di differenza interpretativa tra le versioni linguistiche, prevale la versione turca.
Sorumluluk Reddi ve Kullanım Koşulları
Herhangi bir IFCToolset uygulamasını (“Yazılım”) indirmeden veya kullanmadan önce lütfen bu koşulları
dikkatle okuyunuz. Yazılımı indirerek, kopyalayarak, kurarak, çalıştırarak veya başka herhangi bir şekilde
kullanarak bu koşullarla bağlı olmayı kabul etmiş olursunuz. Kabul etmiyorsanız Yazılımı indirmeyiniz ve kullanmayınız.
Yazılım yalnızca BIM eğitimi amacıyla sağlanmaktadır ve hiçbir ticari veya iş uygulamasında kullanılamaz.
Yazar, Yazılımın ürettiği sonuçlardan hiçbir sorumluluk kabul etmez; bu sonuçlar gerçek hayatta uygulama için
güvenilir değildir. Orinel★ mini dışındaki uygulamalar yalnızca IFCToolset Canlı Eğitimi öğrencileri tarafından
kullanılabilir. Yazılımın üçüncü kişilere dağıtılması, tersine mühendisliğe tabi tutulması veya kırılması kesinlikle
yasaktır ve Türkiye Cumhuriyeti İstanbul mahkemelerinde takip edilecektir.
1. Yalnızca BIM eğitimi amaçlı kullanım
Yazılım yalnızca Yapı Bilgi Modellemesi (BIM) eğitimi ve öğretimi amacıyla — öğrenme, öğretme ve
ticari olmayan akademik çalışmalar için — kullanıma sunulmaktadır. Yazılım, tamamen veya kısmen, ücretli veya
profesyonel tasarım, mühendislik, danışmanlık, inşaat, tesis yönetimi, maliyet tahmini veya uygunluk denetimi işleri,
bir müşteri ya da işveren adına yapılan işler veya ücret karşılığı sunulan herhangi bir ürün ya da hizmet dahil ancak
bunlarla sınırlı olmamak üzere hiçbir ticari veya iş uygulamasında kullanılamaz. BIM eğitimi dışındaki her türlü
kullanım lisanssızdır, bu koşulların ihlalini oluşturur ve tamamen sizin sorumluluğunuzdadır.
2. Yetkili kullanıcılar ve yetkili kopyalar
Orinel★ mini bu web sitesinden indirilebilir ve bu koşullara tabi olmak kaydıyla herkes tarafından BIM eğitimi
amacıyla kullanılabilir. Diğer tüm IFCToolset uygulamaları yalnızca IFCToolset Canlı Eğitimine kayıtlı olan
veya bu eğitimi tamamlamış öğrenciler tarafından ve yalnızca Yazar tarafından kendilerine verilen kişisel,
münhasır olmayan, devredilemez ve geri alınabilir lisans kapsamında kullanılabilir. Yalnızca doğrudan bu web
sitesinden edinilen veya Yazar tarafından IFCToolset Canlı Eğitiminde doğrudan teslim edilen kopyalar
kullanılabilir. Başka herhangi bir kaynaktan edinilen kopyalar lisanssızdır; bunların kullanımı yasaktır ve
Yazarın haklarının ihlalini oluşturur.
3. Üçüncü kişilere dağıtım yasağı
Yazılımın üçüncü kişilere dağıtılması kesinlikle yasaktır ve hukuka aykırıdır. Yazılımı, herhangi bir
bölümünü veya ona ilişkin herhangi bir lisansı ya da erişimi; dosya paylaşım hizmetleri, web siteleri, ağlar, taşınabilir
ortamlar veya mesajlaşma dahil olmak üzere hiçbir yolla, ücretli veya ücretsiz olarak başka herhangi bir kişi ya da
kuruluşa kopyalayamaz, paylaşamaz, yayımlayamaz, yükleyemez, yansıtamaz, barındıramaz, iletemez, ödünç veremez,
hediye edemez, satamaz, kiralayamaz, alt lisanslayamaz veya başka bir şekilde erişime sunamazsınız. Her kopya yalnızca
kendi kullanıcısına lisanslanmıştır. Her türlü dağıtım, Yazarın telif hakkının ve bu koşulların ihlalini oluşturur.
4. Tersine mühendislik, kırma ve kurcalama yasağı
Yazılımı tersine mühendisliğe tabi tutamaz, kaynak koda dönüştüremez, ayrıştıramaz, şifresini çözemez,
kıramaz, yamalayamaz, değiştiremez, uyarlayamaz veya Yazılımdan türev eserler oluşturamazsınız; bunlara teşebbüs
de edemezsiniz. Ayrıca Yazılımın kaynak kodunu, algoritmalarını veya iç yapısını çıkaramaz; herhangi bir lisans
denetimini, kullanım kısıtlamasını, dosya boyutu sınırını, koruma önlemini veya teknik sınırlamayı kaldıramaz, atlatamaz,
devre dışı bırakamaz veya aşamaz; herhangi bir telif hakkı, lisans, marka veya atıf bildirimini kaldıramaz ya da
değiştiremezsiniz. Bu hüküm Yazarın kendi koduna ve bir bütün olarak Yazılıma uygulanır; Yazılıma dahil edilen açık
kaynaklı bir bileşenin lisansının o bileşen bakımından tanıdığı hiçbir hakkı kısıtlamaz (bkz. madde 12).
5. Yasal işlem
Yazılım, 5846 sayılı Fikir ve Sanat Eserleri Kanunu dahil olmak üzere Türkiye Cumhuriyeti telif hakkı ve fikri
mülkiyet mevzuatı ile uluslararası antlaşmalar tarafından korunmaktadır. Her türlü yetkisiz kullanım, dağıtım,
tersine mühendislik, kırma, kurcalama veya bu koşulların başka herhangi bir ihlali, Yazar tarafından hukukun izin
verdiği en geniş ölçüde Türkiye Cumhuriyeti İstanbul mahkemelerinde takip edilecektir. Yazar; ihtiyati
tedbirler ve geçici hukuki korumalar, ihlal eden kopyaların ve bunların üretiminde kullanılan araçların el konulması ve
imhası, maddi ve manevi tazminat ile ihlal edenin elde ettiği kazancın talebi, yetkili Cumhuriyet Başsavcılığına suç
duyurusu ve mahkeme kararlarının ilanı dahil ancak bunlarla sınırlı olmamak üzere mevcut tüm hukuki ve cezai yollara
başvurma hakkını saklı tutar ve bu hakları kullanacaktır. İhlali tespit etmek, soruşturmak ve gereğini yapmak için
Yazarın katlandığı yargılama giderleri ve vekâlet ücretleri dahil tüm masraflar ihlal edene aittir. Her türlü ihlal,
lisansınızı bildirime gerek olmaksızın derhal ve kendiliğinden sona erdirir; sona erme halinde Yazılımı kullanmayı
bırakmalı ve elinizdeki tüm kopyaları imha etmelisiniz. Sona erme, Yazarın ihlalden doğan tazminat talep etme hakkını
etkilemez.
6. Garanti verilmemesi
Yazılım, tüm kusurlarıyla birlikte ve hiçbir türde garanti verilmeksizin “olduğu gibi” ve “mevcut haliyle”
sağlanmaktadır. Uygulanacak hukukun izin verdiği en geniş ölçüde, yazar Ümit Işıkdağ ve tüm telif hakkı sahipleri
(birlikte “Yazar”); ticarete elverişlilik, belirli bir amaca uygunluk, mülkiyet, hak ihlali bulunmaması, doğruluk,
eksiksizlik, güvenilirlik, sistem entegrasyonu ile hata, kusur, virüs veya diğer zararlı bileşenlerden arınmışlık
garantileri dahil ancak bunlarla sınırlı olmamak üzere açık, zımni, kanuni veya başka türden tüm garantileri reddeder.
Yazar, Yazılımın ihtiyaçlarınızı karşılayacağını, kesintisiz çalışacağını, donanımınız, yazılımınız veya dosyalarınızla
uyumlu olacağını ya da kusurların giderileceğini garanti etmez. Yazardan veya bu web sitesi aracılığıyla elde edilen
sözlü veya yazılı hiçbir tavsiye ya da bilgi, bu koşullarda açıkça belirtilmeyen bir garanti doğurmaz.
7. Sorumluluğun sınırlandırılması
Uygulanacak hukukun izin verdiği en geniş ölçüde, Yazar hiçbir durumda size veya herhangi bir üçüncü kişiye karşı;
Yazılımın veya ürettiği herhangi bir sonucun indirilmesi, kurulması, kullanılması, kötüye kullanılması veya
kullanılamamasından doğan ya da bunlarla bağlantılı olan doğrudan, dolaylı, arızi, özel, sonuç olarak ortaya çıkan,
örnek niteliğinde veya cezai zararlardan; veri, dosya, model, kâr, gelir, iş, sözleşme, itibar veya beklenen tasarruf
kayıplarından, iş kesintisinden, ikame mal veya hizmet maliyetinden, proje gecikmelerinden, yapım kusurlarından,
kişisel yaralanmadan, mal hasarından veya donanım, yazılım ya da sistemlere verilen zarardan — nasıl meydana gelirse
gelsin ve sözleşme, haksız fiil (ihmal dahil), kusursuz sorumluluk veya başka herhangi bir sorumluluk esasına
dayansın — bu tür zararların olasılığı kendisine bildirilmiş olsa dahi sorumlu tutulamaz. Yazılım ücretsiz olarak
sağlandığından, sorumluluğun tamamen kaldırılamadığı hallerde Yazarın toplam sorumluluğu, Yazılım için ödediğiniz
tutarı, yani sıfırı aşamaz.
8. Profesyonel tavsiye niteliği taşımaması
Yazılım teknik bir yardımcı araçtır. Mühendislik, mimarlık, yapısal, yangın güvenliği, erişilebilirlik, enerji,
çevre, maliyet danışmanlığı, hukuk veya başka herhangi bir alanda profesyonel tavsiye sağlamaz ve hiçbir yapı
yönetmeliğine, mevzuata, standarda veya sözleşmeye uygunluğu belgelemez. Yazılımın ürettiği hiçbir şey, yetkin ve
ruhsatlı bir uzmanın değerlendirmesinin, incelemesinin ve onayının yerini tutmaz.
9. Sonuçlar: sorumluluk kabul edilmez, gerçek hayatta uygulama için değildir
Yazar, Yazılımın ürettiği hiçbir sonuçtan hiçbir şekilde sorumluluk kabul etmez. Sonuçlar gerçek hayatta
uygulama için güvenilir değildir ve hiçbir gerçek tasarım, yapım, güvenlik, satın alma, finansal, hukuki
veya başka bir kararın dayanağı olarak kullanılmamalıdır. Geometri, metrajlar, alanlar, hacimler, maliyetler, karbon
değerleri, çakışma sonuçları, iş programları, uygunluk ve doğrulama sonuçları, yangın, kaçış, gün ışığı, akustik,
ısıl, güneş ve yapısal kontroller ile dışa aktarılan veya sıkıştırılan dosyalar dahil ancak bunlarla sınırlı olmamak
üzere Yazılımın tüm çıktıları yalnızca BIM eğitimi için üretilmektedir. Bu çıktılar girdi dosyalarının içeriğine ve
kalitesine, üçüncü taraf kütüphanelere ve Yazılıma yerleştirilmiş basitleştirilmiş varsayımlar ile varsayılan
kurallara bağlıdır; eksik, yaklaşık veya hatalı olabilir. Bunlara güvenmek tamamen sizin sorumluluğunuzdadır.
10. Dosyalarınız ve sorumluluğunuz
Yazılımı kullanımınızdan, Yazılımla açtığınız, işlediğiniz, dönüştürdüğünüz, sıkıştırdığınız veya dışa aktardığınız
dosyalardan ve tüm verilerinizin eksiksiz ve güncel yedeklerini almaktan yalnızca siz sorumlusunuz. Önemli
dosyaların her zaman kopyaları üzerinde çalışınız. Sıkıştırılmış veya dönüştürülmüş IFC dosyaları dahil olmak üzere
Yazılımın yazdığı dosyalar asıllarından farklı olabilir; bunları kullanmadan önce kontrol etmek sizin
sorumluluğunuzdadır. İşlediğiniz her dosyayı kullanma hakkına sahip olmanızı sağlamak ve Yazılımın ve çıktılarının
kullanımına uygulanan tüm yasalara, düzenlemelere, sözleşmelere ve üçüncü kişi haklarına uymak sizin
sorumluluğunuzdadır.
11. Tazmin yükümlülüğü
Yazılımı kullanmanızdan veya kötüye kullanmanızdan, Yazılımla üretilen herhangi bir sonuçtan veya dosyadan, bu
koşulları ihlal etmenizden ya da herhangi bir yasayı veya üçüncü kişi haklarını ihlal etmenizden doğan veya bunlarla
ilgili olarak üçüncü kişilerce ileri sürülen her türlü talep, istem, kayıp, yükümlülük, zarar, masraf ve gidere
(makul avukatlık ücretleri dahil) karşı Yazarı tazmin etmeyi, savunmayı ve zarardan ari tutmayı kabul edersiniz.
12. Üçüncü taraf bileşenler, açık kaynak hakları ve lisans bildirimleri
Yazılım, her biri kendi lisansı kapsamında kullanılan üçüncü taraf açık kaynaklı bileşenler ve Microsoft çalışma
zamanları içerir. Araçlarda kullanılan bileşenlerin açık kaynak lisanslarının tanıdığı tüm haklar tamamen
geçerliliğini korur. Her bileşen kendi lisansına tabi olmaya devam eder ve bu koşullardaki hiçbir hüküm, söz
konusu lisansın o bileşen bakımından tanıdığı herhangi bir hakkı, izni veya yükümlülüğü — bileşenin kendisini
kullanma, inceleme, değiştirme ve yeniden dağıtma ile lisansın öngördüğü hallerde kaynak koduna erişme hakları dahil —
sınırlamaz, geçersiz kılmaz veya ortadan kaldırmaz. Bu koşullardaki kısıtlamalar o bileşenlere değil, Yazarın kendi
eserine ve bir bütün olarak Yazılıma uygulanır. Üçüncü taraf lisans bildirimleri her uygulamanın içinde
bulunmaktadır: uygulamanın menüsünü (sol üst) açıp Third-party licenses seçeneğini seçiniz. Bu
bileşenler ilgili sahipleri tarafından Yazarın herhangi bir garantisi olmaksızın sağlanmaktadır ve Yazar bunlar için
hiçbir sorumluluk kabul etmez.
13. İndirmeler ve güvenlik
Yalnızca bu web sitesinden edinilen veya Yazar tarafından IFCToolset Canlı Eğitiminde teslim edilen kopyalar
yetkilidir (bkz. madde 2). Yazar, başka herhangi bir kaynaktan edinilen kopyalardan veya Yazılımda başkaları
tarafından yapılan değişikliklerden sorumlu değildir. Makul özen gösterilmekle birlikte Yazar, Yazılımın veya bu web
sitesinin virüslerden veya diğer zararlı bileşenlerden arınmış olduğunu garanti etmez; indirilen dosyaları taramak ve
sistemlerinizi korumak sizin sorumluluğunuzdadır. İşletim sisteminiz veya güvenlik yazılımınız bağımsız
geliştiricilerin yazılımları hakkında uyarı verebilir; Yazılımı çalıştırıp çalıştırmama kararı sizin
sorumluluğunuzdadır.
14. Destek veya güncelleme yükümlülüğü bulunmaması
Yazarın Yazılım için destek, bakım, güncelleme, düzeltme veya yeni sürüm sağlama ya da Yazılımı veya bu web sitesini
erişilebilir tutma yükümlülüğü yoktur. Yazılım, özellikleri ve bu koşullar herhangi bir zamanda bildirimde
bulunulmaksızın değiştirilebilir, askıya alınabilir veya sonlandırılabilir.
15. Lisans ve izin verilen kullanım
Yazılım satılmaz, lisanslanır. Yazılım BIM eğitimi için ücretsiz bir yazılımdır: 1 ila 4. maddelerdeki sınırlar
dahilinde yalnızca BIM eğitimi ve öğretimi amacıyla ücretsiz olarak kullanabilirsiniz. Her türlü ticari ve iş amaçlı
kullanım yasaktır. Yazılım ve Yazılım üzerindeki tüm telif hakları ve diğer fikri mülkiyet hakları münhasıran Yazara
aittir. Bu koşullarda açıkça tanınmayan tüm haklar Yazar tarafından saklı tutulmaktadır.
Yazılım ticari bir yazılım değildir. Yazılımın satılması ya da Yazılım, bir kopyası veya Yazılıma erişim için herhangi bir ücret alınması kesinlikle yasaktır. Yazılım kapalı kaynaklıdır: kaynak kodu yayımlanmaz veya verilmez; kaynak kodunu edinme, görme, inceleme veya ondan türetme hakkı tanınmaz.
16. Gizlilik
Yazılım bilgisayarınızda yerel olarak çalışır ve çevrimdışı çalışacak şekilde tasarlanmıştır; modellerinizi veya
dosyalarınızı karşıya yüklemez. Yazılımla işlediğiniz verilerin güvenliği ve gizliliği sizin sorumluluğunuzda
kalmaya devam eder.
17. Yüksek riskli kullanım
Yazılım, arızasının veya sonuçlarındaki bir hatanın ölüme, kişisel yaralanmaya veya ciddi fiziksel, maddi ya da
çevresel zarara yol açabileceği kullanımlar için tasarlanmamış, amaçlanmamış ve onaylanmamıştır. Bu tür her kullanım
tamamen sizin sorumluluğunuzdadır.
18. Uygulanacak hukuk, yetkili mahkeme ve bölünebilirlik
Bu koşullar ile Yazılımdan veya bu koşullardan doğan ya da bunlarla bağlantılı her türlü uyuşmazlık veya talep
Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıkların çözümünde İstanbul Mahkemeleri ve İcra Daireleri
münhasıran yetkilidir ve bu yetkiyi kabul edersiniz. Ülkenizin hukukunun belirli garantilerin hariç
tutulmasına veya belirli sorumlulukların sınırlandırılmasına izin vermediği hallerde, yukarıdaki istisnalar ve
sınırlamalar izin verilen en geniş ölçüde uygulanır. Bu koşulların herhangi bir hükmünün geçersiz veya
uygulanamaz olduğu tespit edilirse, söz konusu hüküm izin verilen en geniş ölçüde uygulanır ve diğer hükümler tüm
geçerliliğini ve yürürlüğünü korur.
19. Bu koşullardaki değişiklikler
Yazar bu koşulları, güncellenmiş bir sürümü bu web sitesinde yayımlayarak herhangi bir zamanda değiştirebilir.
Yazılımı indirdiğiniz veya kullandığınız tarihte yürürlükte olan sürüm, o indirme veya kullanım için geçerlidir.
20. Kabul
Yazılımı indirerek veya kullanarak bu koşulları okuduğunuzu, anladığınızı ve kabul ettiğinizi ve Yazılımı tamamen
kendi sorumluluğunuzda kullandığınızı teyit etmiş olursunuz.
21. Dil sürümleri
Bu koşullar İngilizce, Türkçe, Fransızca, Almanca, İtalyanca ve İspanyolca olarak yayımlanmaktadır. Dil sürümleri
arasında herhangi bir farklılık veya yorum farkı bulunması halinde Türkçe sürüm esas alınır.
